An aggressive defense of your case typically starts early in the proceedings including pre-charging conferences and bail hearings. After charges are filed, we examine the facts of the case and oftentimes file pretrial motions challenging such things as an unlawful arrest, an unlawful search, an improperly obtained confession, or otherwise confront weaknesses in the prosecution's case. These motions are typically resolved prior to trial and, if successful, may result in the dismissal of charges.

In the event that pretrial motions or a successful plea bargain does not successfully result in the resolution of the case our attorneys are always prepared to aggressively pursue the defense of our clients at jury trial. We have litigated dozens of charges through the jury trial process including acquittals of such charges as attempted homicide, sexual assault, drug distribution, battery to law enforcement, recklessly endangering safety, battery, and disorderly conduct.

- There are several ways to successfully defend a client against a drug charge. Many times the issue might be possession for personal use versus possession for distribution. There are also oftentimes challenges to the legality of a traffic stop, residential search, or search of the client's person. If proven illegal, a "bad search" may lead to the suppression of evidence and an eventual dismissal of charges. Many of our other clients have drug dependency issues. We may refer clients with drug issues to a qualifed counseling program in the hope that the judge and prosecutor will see fit to allow our clients a "second chance."
06.Drunk Driving Defense
- There are many aspects of a drunk driving case that are ripe for challenge. Before we make any decisions with regard to a drunk driving case we first request all of the police reports, witness statements, squad videos, booking room videos, etc. We want to make sure that we have all of the available evidence in order to properly evaluate the strength and weaknesses of the case against our client. The kinds of things that we look to challenge are the traffic stop itself, the decision to subject our client-driver to field sobriety testing, the propriety of the field sobriety testing, the results of the field sobriety testing, and the accuracy of the breath or blood test. If necessary we consult with our clients on the advisability of hiring expert witnesses (such as toxicologists and accident reconstructionists) to assist our defense.
